A Texas woman, found with 33 dead dogs in a U-haul, wants the evidence resulting from the search of the vehicle to be tossed out. The accused, 36-year-old Christina Arriaga, believes that the May 2018 search of the U-Haul was not warranted. A court document explains:

Defendant respectfully submits that if the State wishes to justify the sudden and warrantless stop of Defendant’s vehicle with some probable cause, the state should have first sought a search or arrest warrant, as in most civil societies. They do not argue any emergency factors, only that a number of dogs were being transported across town for safe-keeping.”

A Pharr police officer asked for the U-haul to be opened after noting a “strong smell” from the parked truck. The woman allegedly told the authorities that, “she and her husband came up with the plan to rent the U-Haul truck, and place the canines inside of the box truck and drive them around until the City of Pharr Animal Control left their apartment.”

Arriaga has pleaded not guilty to the charges.
