In a packed Austin courtroom on Thursday, a packed audience cheered as the judge made the decision not to return the dog named Boone to his former owner.

Judge Tanisa Jeffers ordered the eight-year-old Blue Lacy, caught on a viral video being repeatedly beaten on an apartment balcony, be separated from his owner, John Kaschak. Boone is to remain at the Austin Animal Center. Kaschak was also ordered to pay nearly $900 for treatment and boarding expenses. The cost would continue to increase depending how long Boone remains at the shelter.

I do find John Stewart Kaschak is the owner of Boone, and that Boone was cruelly treated.
Testifying in court was Melissa Folger, who lives in the condo above Kaschak. She had heard the dog barking and yelping in what she described as “distress.” That’s when she recorded the disturbing cruelty towards the dog after trying two times to get police to respond to her calls.
Kaschak was not present in court, but his attorney told the judge his client wanted to maintain ownership of his dog. He has 10 days to appeal the judge’s decision.

According to the statement posted on the Facebook page of the Austin Police Department, officers had responded to an animal urgent call around 3:56 p.m. Sunday, February 8, at the SEVEN Apartments, located at 615 West 7th Street. Police said they had received multiple reports from residents and members of the public about videos that appeared to show a dog being physically abused on an apartment balcony.
