A Bronx, New York man who kicked a Chihuahua so hard that the dog lost its eye has been sentenced to prison. Dwayne Smith, 28, was sentenced to two years in prison by Bronx Supreme Court Justice April Newbauer on Monday.
According to the Daily News, Bronx District Attorney Darcel Clark stated Smith will serve the maximum two-year sentence for the dog that suffered trauma from losing its eye as well as multiple injuries. Smith pleaded guilty to Aggravated Cruelty to Animals.
“… We will continue to prosecute those who commit such cruelty against defenseless animals.”
During an investigation that began one year ago, Smith had reportedly been in an argument with the dog’s owner and her family members. Surveillance cameras showed the defendant kick the 11-pound Pooches in the head sending her flying in the air until she banged against a brick wall.
The defenseless and unconscious dog fell to the ground with her eye bulging out of its socket and bleeding. She also suffered a fractured cheekbone and extensive bruising before having to have her eye surgically removed.
Once out of prison, Smith must register with the NYC Animal Abuse Registry and is banned from owning any animals for the next ten years.
