Charge reduced from felony to misdemeanor after dog dies of heatstroke in yard

An Ohio man is only facing a misdemeanor animal cruelty charge for the death of his dog, who died of heatstroke while tethered in a yard. As reported by WFMJ News, Raphael Carswell pleaded not guilty to the charge stemming from the June 28 incident, which claimed the life of a dog named Fat Boy.

Prosecutors decided to drop the felony to a misdemeanor because they believe that Carswell is more likely to be convicted of the lesser charge. Brian Macala, Campbell Law Director, explained why:

“The decision was made after discussing the matter with detectives and the Campbell Police Department to charge the individual in this case with a misdemeanor in the second degree. We have great confidence that we will get a conviction.”

Fat Boy died in the yard of his owner’s Campbell home – Carswell claims that it was an “accidental death,” and that his dog was otherwise healthy. He is due back in court in January.
