No charges for person who shot dog

The person who shot a dog in the head with two arrows will not face any charges. According to the Sanilac Broadcasting Company, the Sanilac County (Michigan) prosecutor’s office made the announcement on Wednesday – the individual responsible for shooting the seven-year-old husky mix stated that the dog, named Marty, had been attacking his goats on the day of the incident.

The release stated:

“The evidence tends to support the person’s story that the dog was in the act of attacking his goats at the time that he shot at it, if proven true, he would have a legal justification for his action.”

Marty belongs to Jason Lumley. Lumley’s two dogs had escaped from their home and had been missing for two weeks – on January 12, Marty returned home with the two arrows lodged in his head. Investigators learned that the dogs were actively attacking the man’s goats, inside of their pen, when he resorted to using a crossbow – there was evidence on the property to support the livestock owner’s explanation of what happened. Michigan law states that a person can kill a dog who is in the act of pursuing, worrying or wounding livestock.

Amazingly, Marty survived the shooting and he has already returned to his home. The release offered words of advice for dog owners:

“While it is fortunate that the dog is expected to recover, this case serves as a good reminder that it is a dog owner’s responsibility to keep the dog safely at home so that incidents like this do not occur.”

  1. THE LAW IN MICHIGAN SEEMS TO BE FU%KED UP. FIRST OF ALL IT IS NEVER THE ANIMAL’S FAULT. I UNDERSTAND ANIMALS CAN ESCAPE FROM THEIR HOME BUT WHERE THE HELL WAS THE OWNER. THE DOGS PROBABLY LIVE OUTSIDE WHICH IS NOT MY OPTION FOR AN ANIMAL. I STILL SAY THERE SHOULD BE CHARGES AGAINST THE SHOOTER EVEN THOUGH THE DOGS TRESPASSED ON HIS PROPERTY WHAT THE HELL DOES THE ANIMAL KNOW. IT IS THE OWNERS OF THE DOGS WHO TO BLAME. HOPEFULLY SOMEBODY WILL PUT AN ARROW IN THE SHOOTER’S HEAD OR HIS KIDS, WIFE AND PARENTS TO SHOW HIM HOW IT FEELS. PROTECT YOUR ANIMALS IN ANOTHER WAY IN CASE A LOOSE DOG COMES AROUND IDIOT.

  2. The dogs couldn’t be chased away any other way? I don’t support “killing” dogs even if they are allegedly “attacking” your goats. Call animal control or the police (of course the police would probably just shoot the dog) but don’t kill someone’s pet without trying to find another way!

  3. I am just glad the dog will recover – this owner needs to ensure the dogs are kept safely on their property – apparently this was not much of a concern as to where they were. Some people should never have animals if they can’t keep them safe. Since the dog was returned to the owner I am pretty sure this will happen again, and maybe not with good results.

  4. It is also good sense to use other ways of handling something other than shooting it God face you a brain. Use it Killing is NOT the answer.

  5. I understand about a dog attacking another animal and you need to stop the dog. There has got to be another way. I feel for the goats as well. yes it is our responsibility as owners to keep our dogs safe and teach them to stay home. Shooting a dog with a cross bow is just a way for this imbecile to use his toy.
