U.S. government wanted man who killed bald eagle with ATV to go to prison

On Monday, Allen Thacker, 62, was sentenced, however there will be no jail despite the United States government arguing he deserved time in federal prison for shooting a bald eagle and then running it over with his all-terrain vehicle.

According to the Williamsburg Yorktown Daily News, Thacker was sentenced to a $500 fine, $1,500 restitution payment, 100 hours of community service, one-year probation and one month of home confinement after the Smithfield man pleaded guilty to killing the bald eagle. Government lawyers argued Thacker should have received two weeks in federal prison and an additional five months of home confinement. Thacker violated the Bald and Golden Eagle Protection Act with prosecutor’s describing his actions as “egregious and distressing.”

“The killing of the Bald Eagle offends many Americans as an affront to the United States itself,” documents stated. “Although there is no evidence in the record to suggest the defendant harbors anti-American views, his wanton killing of the Bald Eagle would lead many to characterize the defendant in this manner.”

In July, Thacker  tried to scare the bird from hunting fish in his pond with a warning shot, but when the bird refused to leave, Thacker wounded the eagle shooting at him with a .22 caliber rifle. He then told authorities he used a pistol to “finish the bird off.”  A witness reports, when the eagle landed after it was shot, Thacker ran over the bird with his all terrain vehicle – although when originally questioned by authorities, he denied it, AbcNews reported. The witness reported Thacker drove in a circle and ran over the eagle at least three to four times before he dragged it into the woods.

The necropsy of the eagle determined it died from blunt force trauma. The .22 rifle did wound the bird, however there was no evidence of any pistol shots. The eagle apparently died a torturous death as Thacker repeatedly ran over it with his ATV.

In an interview with agents from the United States Fish and Wildlife Service, (USFWS) Thacker stated that “too much emphasis is placed on bald eagle protection because the birds are a menace.”

Thacker’s restitution payment will be made to the North American Wetlands Conservation Fund Account and his community service will be with the National Wildlife Refuge. Let’s hope he learns to respect nature.

  1. Just another example of the ineptitude of our judicial system. This man is a menace and takes the law into his own hands. He will do it again. Find out the judge’s name and vote him out of office when he’s up for re-election!

  2. It’s utterly inexcusable that this POS isn’t going to jail! Two weeks wasn’t even long enough for what he did! Not only was it cruel, but YES, it was the same as taking a dump on this country! I will guarantee you that this piece of pond scum is one of those HYPOCRITES who gets all bent out of shape every time one of “those people” burns a flag, but there he is, doing the EXACT SAME THING to a LIVING SYMBOL of our nation! A flag is an inanimate object without feelings: I hate to think of how that poor eagle suffered when this vile old man shot him and then ran him over, all the while knowing that he’s a symbol of our nation and CHERISHED as such. He’s been taught that the eagle is SPECIAL the same as the rest of us, but he CHOSE to **** on our country instead.

    To me, that says that he’s a hypocrite if he even claims to care about this nation in any way, shape, or form. He deserves to be locked up and should have been. Bastard!

  3. I always thought the bald eagle was protected by law, and this thug gets away with a punishment like this? I guess the government has better things to do than to protect a national bird! (sarcasm) What the better things they are doing however are not very apparent to me at this time. Does anyone “really” think Thacker will gain any respect for wildlife by making a restitution payment to the North American Wetlands Conservation Fund Account and performing his community service with the National Wildlife Refuge? I hope so but think it highly doubtful!

  4. The eagle isn’t the menace but this scum is. Hope he does serve the jail time that he deserves. Someone should shoot at him and run him over several times with an ATV. Horrible way for that eagle to die.

  7. Another example of the lousy judicial system – this man killed the national bird and got no punishment – what a joke – this country is well on its way to having no one punished for a crime.

  8. This pen head learned absolutely nothing….. already making excuses and saying to much emphasis on the bald eagle…… DO NOT LET HIM HURT ANOTHER ANIMAL while working at the wetlands as his restitution!!!!!!!!!
