Neighbor pleads guilty to killing two-pound Yorkie with pruning shears

In St. George, Utah, a tiny two-pound Yorkie who died will finally get some justice – although by most people’s standards, reading about this will think the punishment is by no means enough. On Monday, Kenyon Clark Benson, 74, pleaded guilty to killing the pint-sized Yorkshire terrier named Chewy with pruning shears.

According to the City Cedar News, Benson told Judge Douglas Whitlock in Washington County Justice Court, the dog’s death was an accident. He pleaded guilty to a Class C misdemeanor charge of aggravated animal cruelty.

In November, the St. George Police Department responded to a call from a woman, stating a man had beaten her little dog to death with a pair of gardening shears. The small dog had entered Benson’s yard while he was pruning his landscape after Chewy was let outdoors. According to Benson, the dog came running over to him barking and when he tried to “shoo the dog away” by swinging the pruning shears, it accidentally hit the dog in the head killing Chewy instantly. The youngster, Hailey witnessed the terrible attack and ran into her house screaming that the neighbor had killed her dog.

As part of Benson’s plea deal, he was sentenced to serve 90 days in jail with the time suspended, but would remain on a 12-month-bench probation instead. He was also ordered to pay $2,109.03 in restitution to the court and write a full page letter of apology to the 12-year-old girl who witnessed the brutal death of her beloved dog.

  2. What kind of punishment is this for brutally killing a little dog in front of a child! A letter of apology? What a crock of s**t! That little girl will live the rest of her life with the image of this POS killing her little dog! He deserves prison and not the slap on the wrist he is getting with his “plea deal”! This was NO accident and the court allowing this thug to get away with this is despicable! I hope the family who lost this dog sues the crap out of this POS! This is hardly justice!

      I hope the family hires a shark lawyer and sues this POS neighbor for a huge sum (especially counseling for the little girl, who is now traumatized for life from seeing her precious little treasure murdered in front of her)……

      BTW: if that POS were my neighbor, his life would become a living hell with all kinds of misfortunes (damages to his car, garden, home)……… not to mention being sued into financial oblivion……..

      I know that this POS is going to burn in Hell forever for his cruelty (but he deserves to get there ASAP after a violent, terrifying death)……..

  4. So much for Utah just !!! The Judge probably goes to the Mormon Church with the Positive Putrid ASSHOLE that Killed a tiny little DOG for Christ’s Sake!!! At the very least this man should have made several thousand dollars in restitution to the family of the little pup he killed…

  5. Once again a slap on the wrist! This state obviously has horrible animal protection laws as this was only a misdemeanor! Pretty sad that a grown man felt the need to brutally kill something so teeny tiny! He is clearly a POS through and through! I read that Utah still uses a gas chamber to euthanize dogs! And that is a very horrific,slow and painful way to die! I will never ever step a toe in this mid evil state! They are too asinine to have any shame in the way they deal with companion animals and every resident residing there must think all this is a-ok! JUST SICKENING!!

  6. That’s no punishment, especially when you consider that evil piece of s**t traumatized that child for the rest of her life! What good will a letter do her in light of the trauma she’s going to live with and the nightmares she’ll have? Are you kidding? What kind of justice is this? What kind of IDIOT judge is that? How can he even claim it was an accident and keep a straight face? Good news is, he swore it on a Bible, so odds are he’ll pay in the next world at least…..

  8. This is when the laws need to change for people who kill animals, whether it be “accidental” or on purpose. What kind of insane man does something like this in front of a child? He knew what he had in his hands yet he used that to “shoo” this tiny dog away and killed him instantly. Had he any remorse to the little girl when it happened, or her family? Did he even show any type of sympathy? Highly doubt either of those.

  9. Should be a felony! Bastard. Why wouldn’t he put the shears down like a decent person catch the little dog and bring it back to the little girl. I’d like to see him get the death penalty and killed the same way. Sickening.

  10. Not to play Devil’s Advocate but I never let my dog out without a leash. If the dog would have been on a leash this would not have happened. But to swing a pair of gardening shears at the dog was excessive, I really don’t think the dog could have hurt the man and he could have just yelled at the kid to come get the dog off of his property. RIP little Chewy, I’m sorry everybody failed you.

  11. That is way to much bull shit!! He shooed the dog away by swinging the shears at him……and then pleads guilty to a misdemeanor …..what if a child came yelling at him in the yard..would he swing the shears at child.. possibly kill.and get off because he pleaded guilty….?????
    That seems to be how all the wealthy lawyers get these bastard idiots off the hook by having them plead innocent…then given probation……now animal abuser know exactly what to say and do!!!!!

  12. Man is 74, no way he deserves to die anywhere but in jail Can’t believe this Worthless judge. So sorry this young girl had to witness her pup murdered. She will have PTSD for life and all the judge makes the guy do is send her a letter. How’s about awarding the family money for the wrongful death of their family member. I realize wrongful death isn’t recognized for dogs; but I think it should be. They are family to many people.

There is NO way I believe this old bastard ‘accidently’ killed Chewy – and of course, the courts treated it was a minor inconvenience and gave him a slap on the wrist – I hope his 90 day sentence is one of intimidation, abuse and he is terrified every day. May his life become one of misery, pain and constant suffering.

    But…. playing devils advocate – WHY WOULD YOU LET A TINY little thing like this out if you did not have a fenced yard? They had to know they had a nut/monster living next to them. If I did not have a fenced yard, my furkid would NEVER BE OUTSIDE ALONE…..EVER…..for any reason!

    • I agree. A two pound animal outside “loose” is in danger from aerial predators (hawks, eagles), snakes, and other land predators (coyotes, cougars, bobcats)…….

      I would not let a two pound animal outside unless s/he were in a covered, protected pen………

      If that neighbor had been a decent human being, he would have put his tools down, caught the dog and given him back to the little girl……. instead he was a total POS……….

      I would sue that POS into financial oblivion for the trauma he caused my family………

    • Since a 12 year old girl witnessed the attack, I would imagine the pup was with her and probably scampered away into the neighbor’s yard. Wouldn’t it have been nice, had the POS neighbor just called to the girl and told her to get her dog instead of killing Chewy?
