A Colorado German shepherd that has been in custody at Aurora Animal Control since February, after he was found roaming the neighborhood without a collar and was suspected as being a wolf-hybrid, is just a dog. According to DNA tests, Tracy Abbato’s family 11-year-old German shepherd, “doesn’t have an ounce of wolf in him.”

“I want everyone to know he is not a wolf at all,” Tracy told Kdvr-Tv. “We all knew it from the start.”

The Abbato family adopted Capone from the Adams County Animal Shelter ten years ago. Shelter officials stated he was a German shepherd mix. The family’s veterinarian agreed. A problem, however started when Capone jumped the fence of his home and was picked up by Animal Control, who based on the dog’s looks, his behavior and his mannerisms, classified him as a wolf-hybrid – not allowed in Aurora. Officials refused to release the dog to his family until a DNA test was done – and for the last five weeks, Capone has been held in a kennel cage; his family only permitted to visit with him a few minutes each day.

It is expected to take a few more days before Capone will be returned to his family. Tracy was also charged with allowing her dog to run at large and owning an aggressive animal. A judge is expected to make the decision by Wednesday. And although Tracy admits the situation has been emotionally draining on the entire family, she was encouraged by the hundreds of thousands of animal advocates and dog lovers throughout the nation who came to the family’s support. Now all they can think of is getting Capone home.

“Poor guy… I don’t know what he was going through in there, but I’m sure he’ll be so excited to come home and see us and his furry brothers. I just want him to come home now. It’s time for him to come home,” stated Tracy.

  1. This a SIMPLE case of POWER AND CONTROL!!!! Nothing Else… someone had an issue with this family and THUS THE RESULTS Possible EUTHANSIA!!!! For and innocent animal!!! I was impressed that SEVERAL CONGRESSIONAL MEMBER”S of the COLORADO LEGISLATION were on HAND SUPPORTING THIS FAMILY & THEIR PET OF 10 long year’s ….. I hope they find a safe way to keep their buddy enclosed because there will be a Vendetta with ANIMAL CONTROL over this!!!!

    • I agree with you, I won’t feel real good about this until he is home with his family. I have been suspicious about the dog “jumping” the fence. Most German Shepherds at that age start to have trouble with their legs and are lucky to be able to jump into a car let alone over a fence. The whole scenario has been suspect at best. Here’s hoping there is no more trouble from this, you never know what the ACO’s will come up with next. Let’s hope they just let it go.

      • For some Reason I have had BAD vibes over this whole issue I live in a neighboring state, and a few places we hear about on thru the grape vine… most shelters in Colorado are wonderful area’s and very pet friendly… there has been some trouble with cop shootings, but the higher ups and really made training etc. a MAJOR ISSUE… They don’t care for Pitt’s much… but this is indeed strange… maybe a family issue or dispute ….

  2. I read the previous article which said that there was a DNA test being performed to see if Capone was a “Wolf-Hybrid”. Capone looks like my Brother’s Dog Henry. I could tell that Capone wasn’t a wolf. I am glad that Capone is just a Dog. I am thrilled there is a happy ending to this story. I was wondering how this would turn out.

  3. You would think that after they found out he was just a regular dog, that they would release him to the family. But no, they have to make sure they don’t look bad.,so they have to find something else . Shame on them. But not surprise. Do glad to hear he will be able to go hone.

  4. Really? Didn’t need the test to tell me that! You have kept Capone from his family cost undue stress on Capone and his family! The money spent by both sides in this canine witch hunt is ludicris! The animal control thing who caused all this should be made to pay all expenses! It should be fired and never allowed to go near another animal because this thing is an idiot!

  5. Funny, that’s the result we all KNEW was coming. In fact, everyone knew it was, that is, everyone with a lick of sense, which obviously doesn’t include the a*****s at the animal control facility who would have killed an innocent dog because he ‘looked’ wrong, then ‘acted’ wrong, Of course, common sense should have told them that the ‘acting wrong’ was because he’s a 10 year old dog who’s lived in the same home and was put into a stressful situation, but then there’s that lack of intelligence thing on their part again….. The family should sue these jerks over what was done to them and Capone. This will undoubtedly leave marks on him of some sort, and maybe, if they have to pay a price other than worldwide shaming, it will make them think twice before they do something like it again.

  6. A few more days? Why must he stay a few more days, let these people pay their fines and take their DOG home! I hope Aurora Animal Control is going to foot the bill for all the DNA testing and boarding fees, they are the ones who caused this whole ruckus so I hope they aren’t going to hold this against Capone’s family.

  7. Those “authorities” – lacking ANY foundation whatsoever – had better be held liable for ALL expenses incurred by this family, in addition to all their own (DNA testing – stupid!) costs!

If that jurist DARES to deem this hapless soul “aggressive” there will be SUCH AN OUTCRY that someone may be ousted from office!

Considering ALL they’ve been put through without merit, all charges should be summarily dropped!

  8. How is it that some idiot with no credentials can make an assessment of an animal and just decide it it part wolf? Last I heard that was far beyond the scope and knowledge of an animal control person. And now that they have done the testing why wasn’t this dog returned to his family IMMEDIATELY? Will this stupidity never end? Time someone got fired for abuse of office.

  9. I will always remember capones Terrifying Mug Shot above.
The one with the cat non-chalantly preening himself in capones lap.
    Terrifying.

  10. I sure hope Capone’s owner learned to keep her dog secure and not allowed to roam – whoever evaluated him as a hybrid sure proved themselves a fool – Capone looks real aggressive next to a cat who obviously is not scared of him. What a bunch of BS for no reason.
