SPCA plans to put down family’s dog – agency fighting for his life

In a short period of time, a dog who is accused of killing a cat (two years ago, after he got loose from his home) will be put down by staff at the Charlottesville-Albemarle SPCA. The dog, a five-year-old Staffordshire terrier named “Niko,” allegedly killed the cat, but nobody actually saw him commit the deadly deed.

In a last ditch attempt to save Niko’s life, the non-profit agency, Against All Oddz Animal Alliance, Inc., is working to strike a deal that will spare the accused dog’s life. The agency released a statement on December 15, which reads in part:

Against All Oddz Animal Alliance Inc., based out of Buffalo, New York, is attempting to broker an agreement to help save the life of a death row dog out of Albemarle County, Virginia. Against All Oddz Animal Alliance (AAOAA), is a unique organization in that it is directed by several members of the Western New York legal community, who themselves are also zealous advocates for animals. By integrating elements of law and rescue, they specialize in dealing with dogs enveloped in the legal system.

Niko belongs to Toni Stacy, who lost custody of her dog shortly after he allegedly killed a cat. Stacy does not believe that her dog is responsible for the cat’s death, but an Albemarle County judge sentenced him to death anyway, reported CBS 19 News. Stacy has been told that her dog will be euthanized this Sunday…and she claims that she will not be allowed to be with him during his final moments.

The non-profit animal welfare agency is hoping to legally adopt Niko – a spare him an untimely demise. The agency wrote:

AAOAA has sent correspondences which were received via certified mail by Commonwealth Attorney Robert Tracci Esq. and Circuit Judge Cheryl Higgins offering to take Niko, and explaining their success in dealing with animals who have bitten in the past.

While they have not received permission to adopt Niko as of yet, and while Niko’s owner, Toni Stacy, was allegedly told by Animal Control that Niko will be killed next week, AAOAA founder Matthew Albert Esq. is still hopeful that “reasonable and humane minds prevail and that Niko is given the second chance at life he deserves.”

  1. I feel horrible for the cat but since when is a dog killing a cat a death sentence for the dog? If it was a lab would it still be on death row?

    • Yes agree with Edward bunch of assholes Spca’s and Judge who convicted the dog to be killed. They have no proof it is bunch of talks. Leave tbe poor dog alone. Poor dog he must scared. Please save this dog.

      • Actually they used the word “allegedly”. I follow Toni Stacy on her face book who video tapes her frequent visits with Niko. She commented that Niko had gotten loose she was right behind him and that Niko never attacked or killed a cat.

  3. I have been following this story for months. This dog seems very kind, and if he got into a tangle with a cat, it was most likely a an unfortunate incident. Don’t destroy a dog for being a dog!!!

    • Exactly! I agree 100%. He should be returned to his family for pity sake! Dogs kill cats. History has proven that. That does not make them a dangerous animal. Geez! Stupid judge. No one can even say for sure he is the guilty one.

  4. This is horrible.. How can they just kill niko and they don’t even know if he killed the cat..bad decision.. I pray niko you will be saved..and for two years he’s been without his family.. I pray for u Niko..have mercy on Niko..

  5. How can they kill the dog when they have no proof that he did…. it appears that this dog was not seen by anyone killing the cat. That makes it a guess because he is a big boy and a lot of people are afraid of big dogs. There is something else going on here that no one knows about maybe it was a person who killed the cat and will not say who it is. This boy lives in a house with a child and she is not afraid of him. Please keep me posted on the outcome.

  6. This is so wrong. Why is the immediate reaction to kill. I would hope cool heads would prevail and let AAOAA help this dog. Killing him is not the answer

  7. We see too many of these “allegedly” killed the cat scenario’s and I would be willing to bet Niko didn’t kill the cat at all, but someone has to pay and it will be him. Unless they have proof (bite marks, witnesses, etc.) Niko should NOT have a death sentence. I will be praying that AAOAA is able to save him. Their hope that “reasonable and humane minds prevail and that Niko is given the second chance at life he deserves.” is highly unlikely though, After all Niko is a “Pit Bull” and we all know the bias against this breed.

  8. Alot of dogs will kill cats, it is sad, but if not socialized with cats, will do. It is bs to put this dog down for that and no proof he did it. I am sad the cat died, but people keep your cats in for their safety. This dog got out accidentally from what I read and all animals are curious and will escape if they can. Please do not kill this family pet!!!!!

If i was the owner i wouldnt go to court for the death sentence that is not fair if peole can have their lives spared for killing animals or other people so can dogs i think its bloody wrong i hope that judge goes to fucking hell i believe in karma and karma will come down on him see how he likes it

  12. First, they want to find loving caring families at the dog pounds or else, they’ll euthanize the dog! Then a dog lives with a good family who adores him and now they want to put him down for “assuming” emphasis on the “ass”, that he allegedly killed a cat?   13. What? My cat was killed by my neighbors dog, who was a Corgi. That dog wasn’t put down, nor did I want him to be. Why should both families suffer the loss of losing a pet when it was just animal instinct. Ridiculous.

  16. If a cat came into my fenced in yard when my 2 dogs were outside, they would kill it. They have had no socialization with cats so that is what they do. They’re dogs! They also kill rabbits, squirrels, baby birds, mice, possums, anything that they can. It’s natural.
    As for the cat who was killed, why was it out wandered around? It is my opinion that cat owners should have the same responsibilities as dog owners. Frankly, I am sick of cats catching birds at my bird feeders, shitting in my vegetable garden, spraying my doorways. The cats should be kept inside or on leases when outside.
    This dog does not deserve to be locked up in a cage for 2 years, then killed because of a damn cat running around at large in the neighborhood.
